Protected under national and international law, in France family migration
is considered an easy route to obtain residence rights and is suspected of
creating intra-EU migration chains, the cost of which are ultimately borne
by the Government. As a result, since the 1970s family migration has
undergone several restrictive legislative changes. In light of this
background, this article explores the impediments that migration policies
and their implementation create for the family lives of people who are in
migration or who want to migrate. We carried out a historical, legal and
sociological analysis and looked at case studies relating to the family
reunification procedure and to reuniting couples consisting of a French
citizen and a foreign national. The arrangements reveal three key points:
discrepancies between administrative categories and family circumstances
not covered by law, frictions between biographic and administrative
timeframes, and the construction of undesirability. Children and their
interests, which are affected by these aspects and by administrative
obstacles, are barely taken into account in the procedures. Faced with
administrative uncertainty, family members use various strategies,
sometimes illegal ones, to become reunited. Parenthood therefore seems
inconceivable in migration law, which has proven to be a “right to impede”
for migrant and binational families who are illegitimate in the eyes of the
government and suspected of circumventing legal procedures.
