you are kindly invited to the Lunch Workshop on “Data Sovereignty and the GDPR: US Government Access to European Data".

The workshop will take place in room NU-4A67 (34/17T)


This workshop discusses whether European organisations can use cloud providers which are subject to US jurisdiction as processors under the GDPR, in light of US laws that require providers to disclose data to US law enforcement and intelligence agencies. These disclosure obligations arise from US law only (i.e. the SCA, the CLOUD Act, and FISA) and are not generally recognised under EU or Member State law.

The workshop will be hosted by Dave Michels<https://www.linkedin.com/in/dave-michels-5233681a/> (PhD candidate, Queen Mary London),

During the event, Dave will present the concept of Data Sovereignty and the preliminary findings of the Cloud Legal Project. Subsequently, Dave would like to discuss with the participants and receive their input regarding whether and how a cloud provider’s disclosure of European customer data to the US government can comply with the GDPR, including:

  *   Lawful grounds for processing (Article 6);
  *   Purpose limitation (Article 5);
  *   Processing without a controller’s instructions (Article 29);
  *   Security obligations (Article 32); and,
  *   Lawful international transfers (Chapter V).
