Dear Reader,
We hope April has been splendid and filled with lots of happy moments. Here are some things we have been up to this month.
We can look back at a very successful BILETA 2023<https://alti.amsterdam/bileta23/>, with over 80 physical and over 40 online participants. In 18 parallel sessions<https://alti.amsterdam/programbileta2023/>, interesting presentations were followed by lively discussions, and each day was kicked off with an excellent keynote (Orly Lobel on the Equality Machine and Giovanni Sartor on AI applications in law). Also, some members presented, viz. Zachary Cooper #13<https://alti.amsterdam/bileta23abstracts/#_Toc127543240>, Mark Leiser #42<https://alti.amsterdam/bileta23abstracts/#_Toc127543269> #46<https://alti.amsterdam/bileta23abstracts/#_Toc127543273>, and Silvia De Conca #16<https://alti.amsterdam/bileta23abstracts/#_Toc127543243>. Prizes were awarded to Edoardo Celeste #10<https://alti.amsterdam/bileta23abstracts/#_Toc127543237> (Paul Maharg Education Prize), Bárbara Da Rosa Lazarotto #14<https://alti.amsterdam/bileta23abstracts/#_Toc127543241> (ELJT Prize), Sahil Mathur #54<https://alti.amsterdam/bileta23abstracts/#_Toc127543281> (T&F Prize), and Ethan Shattock #76<https://alti.amsterdam/bileta23abstracts/#_Toc127543303> (Philip Leith Prize).
What are the legal applications and implications of artificial intelligence in the Netherlands? Masja Galic, Abjijd Das and Marc Schuilenburg co-authored the Netherlands’ National Report on AI and Administration of Criminal Justice for the AIDP’s research on AI and Criminal Justice. The report has now been published in the latest issue of e-Revue Internationale de Droit Pénal, pp. 5-61. You can access the report here<https://www.penal.org/fr/2023>.
Ioana Bratu has an article<https://url6649.tandfonline.com/ls/click?upn=odl8Fji2pFaByYDqV3bjGMQo8st9of2228V6AcSFNq3t86qU90pAx-2BEad4OTI0D6hfhph75cH9Slro7-2BnYJowHs5DwhaRH1lkEOyg6UxtvI-3DdQ8d_JZUYwFVaP6X2enkGd2THYMAhAIWaeNZGWjFg5YyVpQVhw7iSJoMU4n0jMX0PS5BeQpFxB4zOMMlIeW8Icroyy8cNoeVpc86AcwP-2F31TqvnAac2kQHE4sVjGkStk6t2Jl-2F2WsqzGSZZDgdeL-2BWegwVwdgHHBQ-2BjWk7WBkLxrtIrvnO2OtwkH7gKl-2FBd7Gi7pYxJxmCvq-2BpcMscfUCfJ-2Fw5s2D-2BoFx0bqg7rwHrJJLcpzs2mtkq7gvZgErWel1GvFvF5JaC8qLPegFT9blfu909A-3D-3D> on the AI Liability Directives proposed by the European Commission in September 2022. In particular, she looks at the European approach to damage caused by artificial intelligence enabled by global navigation satellite systems and asks whether it is a bridge to nowhere or a cloud with a silver lining.
What is the role of innovation in antitrust law? Does the presence or absence of innovation influence judges when making their decisions in competition law cases? In his latest working paper<https://alti.amsterdam/innovation-european-competition-law/> “A Systematic Content Analysis of Innovation in European Competition Law”, Thibault Schrepel analyzes the 5 Ws of innovation, namely, who, what, when, where, and why. He has also submitted two contributions to the European Commission on abuse of dominance in the digital sector. In the first submission<https://ec.europa.eu/info/law/better-regulation/have-your-say/initiatives/13796-EU-competition-law-guidelines-on-exclusionary-abuses-by-dominant-undertakings/F3407400_en>, he proposes the creation of a dynamically-as-efficient-competitor test. In the second<https://ec.europa.eu/info/law/better-regulation/have-your-say/initiatives/13796-EU-competition-law-guidelines-on-exclusionary-abuses-by-dominant-undertakings/F3405651_en>, he suggests a framework to take better account of innovation in digital competition law cases.
On April 18th Silvia De Conca was invited to discuss her latest paper on deceptive design in smart speakers with the Digital Rights Division of the Autoriteit Consument & Markt. Silvia's presentation opened a series of events organised by the ACM Digital Rights Division called "DigiTimes", where the Authority invites expert speakers to discuss pressing matters with consumer protection in the Digital Society.
That’s all for April, see you again next month.
