A legal definition of the ‘sharing economy’ and associated platform-based legal models

The ‘Sharing Economy’ is one of the most critical social, economic, and legal phenomena today. Companies such as Uber, Airbnb, and Getaround epitomize this phenomenon and exemplify its impact on modern society. Despite its disruption, there is still no clear definition of this phenomenon from a legal perspective. Our recent article –– ‘The Sharing Economy & The Platform Operator‐User‐Provider “PUP Model”: Analytical Legal Frameworks’ (2021)31(4) Fordham Intellectual Property, Media & Entertainment Law Journal 997– addressed this problem. This blog post summarizes the main arguments, focusing on the definition of the phenomenon and its differentiation with the concept of ‘Sharing Economy’ –– an incorrect and misleading name for this phenomenon. Rochelle Cooper Dreyfuss: “The Rise (and Fall?) of Trade Secrecy Protection”

For many reasons, the last decade witnessed a dramatic rise in trade secrecy protection. Growing employee mobility increased the risk that valuable information would be taken and used competitively. Confounding that problem, many significant knowledge products—algorithms, data, manufacturing know-how—are not covered by standard intellectual property regimes and thus require a new form of protection. In addition, emerging rights to personal privacy make demands for commercial secrecy more congenial; these rights also furnished firms with novel grounds to withhold the release of data. Perhaps most important, global competitive pressures drew governmental attention to economic espionage and forced technology transfer, thereby sensitizing legislatures to demands for stronger protection. Rebecca Tushnet: “Content Moderation and Disclosure: The Cautionary US Experience”

In the last year, the US states of Florida and Texas have attempted to require large online platforms to be “viewpoint neutral” in content moderation. The purpose was clearly set forth by Florida governor Ron DeSantis in his signing statement: to combat the “biased silencing” of “our freedom of speech as conservatives . . . by the ‘big tech’ oligarchs in Silicon Valley.” (…)
